Supress Products, Creators Of Supress® Sound-Engineered Drywall, Defeat Serious Materials/Quiet Solution Claims Of Patent Infringement
San Rafael, Calif. – December 4, 2007 - Supress Products, LLC announced today that it has defeated claims of patent infringement asserted by Serious Materials LLC, dba Quiet Solution, in federal court. In March 2007, Quiet Solution filed a complaint in the United States District Court for the Northern District of California, action no. C07-01328 RMW, alleging that Supress infringed multiple claims of U.S. Patent No. 7,181,891 (“the ‘891 patent”) and simultaneously announced that it would “make every effort to delight any dealer, builder or contractor affected” by the lawsuit against Supress. Supress denied the allegations, asserted counterclaims for declaratory relief that the patent was invalid and not infringed and vigorously defended the lawsuit.
Conceding that its case had no merit, Quiet Solution stipulated to dismiss its claims for patent infringement with prejudice and further agreed that it would refrain from suing Supress and its distributors, customers or successors, for infringement of the ‘891 patent on any product currently marketed and sold by Supress. This lawsuit was the third Quiet Solution has filed against Supress, and this is the third lawsuit Quiet Solution has dismissed.
